Can You Change a Power of Attorney?

The simple answer is yes, you can change a power of attorney, or LPA, which you have created. The caveat is that it must be registered, and you must still have the mental capacity to make your own decisions.

Power Of Attorney Online

Remember that you can always create an LPA online at sites such as https://powerofattorneyonline.co.uk/.

What Do I Need to Do?

You need to send the Office of the Public Guardian a partial deed of revocation if you wish to remove an attorney. This is a written statement. The OPG provides a form of wording to help make these changes.

If you require another attorney to be added, you need to terminate the existing LPA and create a new one.

Why Would You Need to Change an LPA?

However you have made your LPA, there may be circumstances in which it needs to be changed. It may be that one of your current attorneys or a sole attorney is no longer able to fulfil their duties. If you appointed a professional, they may have retired and you will need to replace them. Alternatively, the attorney themselves may have indicated that they no longer wish to continue in the role.

In the latter case, the attorney has the right to cancel their involvement in decision making. However, once they do so they cannot regain control of your finances or deal with decisions about your welfare by being re-appointed.

Communication is key in these circumstances, since a new attorney may need to be appointed or other attorneys will need to be informed where there is shared responsibility. The OPG will also have to be informed of any changes.

Circumstances in Which the LPA Automatically Ends

There may be a time when your power of attorney will end automatically without you making a decision. This could be because the attorney who currently has the powers in the deed dies, loses their own mental capacity or has financial difficulties themselves resulting in bankruptcy.

In these circumstances a new LPA will have to be created.
